Terms of Service

The present General Terms of Use (referred to as « GTU ») aim to provide a legal framework for the terms of provision of the services (including the mobile application) offered by ledsUp and to define the conditions of access and use of the services by the « User ». The present GTU are accessible on the website under the « GTU » section. Any use of the mobile application implies the User’s acceptance, without any reservation or restriction, of the present GTU. Upon downloading, each user expressly accepts these GTU
by checking the box preceding the following text: « I have read and understood the General Terms of Use and I accept them. »
In case of non-acceptance of the GTU stipulated in this contract, the User must refrain from accessing the services offered by the ledsup.fr website. ledsUp reserves the right to unilaterally modify the content of these GTU at any time.

Article 1: Legal Notice
The company ledsUp has developed the mobile application ledsUp. Its team can be contacted via the email address: contact@ledsup.fr

Article 2: Access to the application and services and platforms
1.1 The ledsup.fr website
The ledsup.fr website allows free access to the following services:

  • Presentation of the ledsUp solution
  • Contacting the ledsUp team

The website is freely accessible anywhere to any internet user with access to the internet.
All costs incurred by the User to access the service (hardware, software, internet connection) are at their expense.

2.1 The ledsUp application
The ledsUp application allows the User free access to the following services:

  • Light animations for shows (concerts, festivals), sports events (matches, competitions), and any other events from mobile phones.

The application is accessible after downloading on a mobile phone (iOS or Android) via the App Store and Play Store. It is available free of charge anywhere to any User with internet access. The company ledsUp cannot be held responsible for the unavailability of the application stores or slow download speeds.
The ledsUp application requires an internet connection.
The company ledsUp cannot be held responsible for total or partial unavailability of the internet network.
All costs incurred by the User to access the services (devices, internet connection, application store, etc.) are at their expense.

Article 3: Modalities of processing and collection of personal data
The ledsUp application does not collect any personal data. The application does not require an account creation to be used.

Article 4 : GPS location feature
The ledsUp application does not require any specific permission to function except possibly GPS with the User’s permission to help the User locate themselves on a map if necessary. The GPS position is neither stored nor memorized. The use of GPS positioning is not mandatory to correctly use the application.

Article 5: Cookies
The ledsUp application does not require any cookies for its operation.

Article 6: URL Links
The company ledsUp reserves the right to display advertising content in the application in the form of one or more advertising banners on the application screen that may redirect to websites using URLs. The User is informed that by clicking on these images, they will exit the ledsUp application. The company ledsUp verifies the link associated with each advertising banner before placing it in the application but has no control over the content of the web pages pointed to by these links. The company ledsUp cannot be held responsible for the content of these URL links. However, the User can report inappropriate content of these links by contacting the company ledsUp at the address indicated in Article 1.

Article 7: Use of the phone
Handling the phone while using the ledsUp Application remains the responsibility of the User.
The company ledsUp cannot be held responsible for any damage to the phone that occurs during the use of the ledsUp application. Firm grip of the phone is essential, especially during light animations (particularly in Ola mode).

Article 8: Copyrights and intellectual property related to the application
The trademarks, logos, signs, as well as all the contents of the ledsup.fr website and the ledsUp mobile application (texts, images, sound, etc.) are protected by the Intellectual Property Code and more particularly by copyright. The ledsUp trademark is a registered trademark of ledsUp SAS. Any representation and/or reproduction and/or exploitation, in whole or in part, of this trademark, of any nature whatsoever, is strictly prohibited. The User must obtain prior authorization from the Company ledsUp for any reproduction, publication, copy of the various contents. The User undertakes to use the contents of the site strictly for private purposes; any use for commercial and advertising purposes is strictly prohibited. Any total or partial representation of this site and this application by any means whatsoever, without the express permission of the ledsUp operator, would constitute infringement punishable by articles L 335-2 and following of the Intellectual Property Code. It is recalled in accordance with Article L122-5 of the Intellectual Property Code that the User who reproduces, copies, or publishes protected content must cite the author and the source.

Article 9: Liability
The sources of the information disseminated on the ledsUp application or on the ledsUp.fr website are deemed reliable but are not guaranteed to be free from defects, errors, or omissions. The information provided is for informational and general purposes only and has no contractual value. Despite regular updates, the website and its services cannot be held responsible for the modification of administrative and legal provisions occurring after publication. Similarly, they cannot be held responsible for the use and interpretation of the information contained on the website and the application. The company ledsUp, the ledsup.fr website, and the ledsUp application cannot be held responsible for any viruses that may infect the mobile phone or any computer equipment of the User, following the use, access, or download from these platforms.
The responsibility of the company ledsUp, of the ledsUp application, of the website, cannot be engaged in the event of force majeure or the unforeseeable and insurmountable act of a third party.

Article 10: Modification of the GTU
The company ledsUp reserves the right to adapt or modify the GTU at any time, the User cannot claim ignorance of these, and is invited to regularly consult the GTU to stay informed of possible changes to these conditions.The GTU are accessible at any time via the menu of the ledsUp mobile application and on the ledsup.fr website.
The company ledsUp cannot be held responsible in the event of unavailability of the website hosting the GTU.

Article 11: Applicable law and competent jurisdiction
French law applies to this contract. In the absence of an amicable resolution of a dispute arising between the parties, the French courts shall have sole jurisdiction to hear it.
